Paradigma alternatif pengembangan : kajian ushul fiqh yang membebaskan perempuan /
This article proposes that Islamic Jurisprudence [ushul a fiqh], as the methodology of classical Islamic law, was laden with male bias. This is due to formulators of ushul al fiqh who are men therefore there must be subjectivity and interest of men when understanding the text [both the Qur'an and the Sunnah] and when conducting istinbath al ahkam from the text a well as because of the absence of a contextual reading of the text. As a result, the products of classical fiqh tend to discredit women and do not put women equal to men. Al Qur'an is believed as a holy book which is appropriate to any circumstances, so it is accepted and is used as a guide for human life throughout the ages [hudan li al nas]. In order that the Qur'an functions as such, a paradigm shift and reconstructive formulation of responsive methodology establishment of Islamic law to contemporary problems of humanity, including women's issues, are required.
